By visiting this Website, the Customer agrees to be bound by the terms and conditions of this Privacy Policy. If the User disagrees with the terms and conditions of the Privacy Policy, the Customer shall not use or access this Website.

In the course of using this Website or availing the products and services vide the online or otherwise, the application forms or questionnaires etc., CIFCL and its Associates may become privy to the personal information including information that is of a confidential nature like bank account, broking account, demat account, investment and net worth details of its Customers and may use the same for various purposes including analysing the credit worthiness of the Customer and providing value added service to Customers. CIFCL undertakes to obtain consent of its Customers, wherever not available, before disclosure or transfer of information to third parties. For the purpose of this Policy, “Personal information” is any information that relates to a natural person which, either by itself or can be used in combination with any other information available with CIFCL, for identifying such person. Personal Information provided in acceptance of this Policy shall amount to written consent to CIFCL.

CIFCL shall not be liable in any manner under Information Technology Act, 2000 and Rules for the authenticity of the personal information or information supplied by the Customer and also third-party information, data or links made available or hosted by CIFCL.

CIFCL will limit the collection and use of Customer information only on a need-to-know basis to deliver better service to the Customers. CIFCL may collect and hold personal information relating to Customer and Customer’s identity that are provided to us, such as on an application or Know Your Client (KYC) and member-client forms. CIFCL may also collect Customers personal information when the Customer use our services or websites or otherwise interact with us during the course of our relationship. Personal information collected and held by us may include, amongst other things, Customer’s father’s name, spouse’s name, date of birth, residential and correspondence addresses (current and previous), telephone number, mobile phone number, email address, education and occupation related details and information contained in the documents used as proof of identity and proof of address and bank account. CIFCL may also hold information related to Customer’s utilization of our services which may include Customers call details, computer IP address, browsing history on our website and additional information provided by the Customer while using our services any other information collected in relation to our products and services.

CIFCL shall use data collection devices such as "cookies" on certain pages of the Website to analyse such web page flow, measure effectiveness of promotional activities and promote safety and trust.   • Inform about our and our group companies products and services which CIFCL consider may be of interest to Customer and may benefit the Customer;
  • Deal and respond with requests, enquiries or complaints and other customer care related activities;
  • General administrative, research and business purposes;
  • Ensure adherence to legal and regulatory requirements
  • CIFCL shall ensure that the personal information collected will be used only to the extent it is necessary to administer our services in the best possible manner and what is required under the various regulations of Indian Laws.
  • CIFCL may use and share the information provided by the Customer with its Affiliates and third parties for providing services and any service-related activities.
  • By using the Website and providing the required information, the Customer authorizes CIFCL, both its present and future associates to communicate with him/her via Email, Phone, SMS or any other means to offer the CIFCL’s services, promotional offers, impart product knowledge as listed on the Website & offers of CIFCL’s associates regardless of the Customers do not disturb (DND) status. In case Customer does not provide information or consent for usage of personal information or later withdraw the consent for usage of the personal information so collected, CIFCL reserves the right to not to provide the services or to withdraw the services for which, the said information was sought.

CIFCL undertakes not to disclose the information provided by the Customers to any person, unless such action is necessary to:

  • Conform to legal requirements or comply with legal process;
  • Protect and defend CIFCL or its Affiliates' rights, interests or property;
  • Enforce the terms and conditions of the products or services; or
  • Confirm the transaction details

There may be certain circumstances, when CIFCL may be required to share the information given by the Customer with the third parties. CIFCL may transfer the Customer’s personal information collected, processed by us to any other entity or organization located in India only in case it is necessary for providing services to Customer or for assisting in protecting the operation of CIFCL networks and systems or if the Customer have consented (at the time of collection of information) to the same.

CIFCL is strongly committed to protect the privacy of its Customers and has taken all necessary and reasonable measures to protect the confidentiality of the Customer information and its transmission through the web or otherwise and it shall not be held liable for disclosure of the confidential information when in accordance with this Privacy Commitment or in terms of the agreements, if any, with the Customers. CIFCL shall take all reasonable steps to ensure that the confidentiality of Customer’s information is maintained by imposing strict confidentiality standards on all the third parties with whom CIFCL part these information. CIFCL shall not allow any third parties to retain the Customer’s personal information longer than what is warranted by the nature of services rendered.

The Customers shall not disclose to any other person, in any manner whatsoever, any information relating to CIFCL or its Associates of a confidential nature obtained in the course of availing the services through the website. Failure to comply with this obligation shall be deemed a serious breach of the terms herein and shall entitle CIFCL or its Associates to terminate the services, without prejudice to any damages, to which the customer may be entitled otherwise.

The Customer authorises CIFCL to exchange, share, part with all information related to the details and transaction history of the Customers to its Associates/banks/financial institutions/credit bureaus/agencies/participation in any telecommunication or electronic clearing network as may be required by law, customary practice, credit reporting, statistical analysis and credit scoring, verification or risk management and shall not hold CIFCL liable for use or disclosure of this information.

As per Regulation 3(2) of the Information Technology (Intermediaries Guidelines) Rules, 2011, CIFCL hereby informs the Customer that the Customer is not permitted to host, display, upload, modify, publish, transmit, update or share any information that —

  • belongs to another person and to which the Customer does not have any right to;
  • is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
  • harms minors in any way;
  • infringes any patent, trademark, copyright or other proprietary rights;
  • violates any law for the time being in force;
  • communicates any information which is grossly offensive or menacing in nature;
  • impersonates another person;
  • contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any system resource;
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.


The Customer is also prohibited from:

  • Violating or attempting to violate the integrity or security of the Website or any CIFCL Content;
  • transmitting any information on or through the Website that is disruptive or competitive to the provision of Services by CIFCL;
  • intentionally submitting on the Website any incomplete, false or inaccurate information;
  • making any unsolicited communications to other Customers;
  • attempting to decipher, decompile, disassemble or reverse engineer any part of the Website;
  • copying or duplicating in any manner any of the CIFCL Content or other information available from the Website;
  • attempting to decipher, decompile, disassemble or reverse engineer any part of the Website;


INDEMNITY

Customer agrees to indemnify and hold harmless CIFCL, its affiliates, officers, directors, employees, and representatives from any and all third-party claims, losses, liability, damages, and/or costs (including reasonable Legal fees and costs) arising from his/her/its access to or use of Website, violation of this Agreement, or infringement by any other Customer of his/her/its account, of any intellectual property or other right of any person or entity. CIFCL will notify the Customer promptly of any such claim, loss, liability, or demand, and in addition to the foregoing obligations, Customer agrees to provide CIFCL with reasonable assistance, at his expense, in defending any such claim, loss, liability, damage, or cost.

CHANGES TO THIS PRIVACY POLICY
